sexual gesture by coercion and surprise

When we look at rape in the context of an act being perpetrated by someone who is familiar to the victim, it often becomes difficult to be subjective and not take that familiarity. When the victim and perpetrator are familiar with each other, the “he said, she said” word play can only be resolved by evidence that the sexual act itself was forced, if it can be proven that coercion went as far as creating feelings of fear in the victim and trauma after the fact, then there wouldn’t be a legal minefield to get through. Rape is more than a sexual gesture by "coercion" and "surprise" and any good lawyer would know how to navigate his way through the loopholes.
